Terms of Use
These general terms govern access to Automate.Marketing and provide the common legal framework for websites, digital products and brands operated by Marketing Automation Ltd.
1. About these terms
These Terms of Use (“Terms”) apply when you access Automate.Marketing or other general websites and digital services operated by Marketing Automation Ltd (“Marketing Automation”, “we”, “us” or “our”). Our statutory company details and registered office are shown in the legal footer below.
By using a service covered by these Terms, you agree to comply with them. If you purchase, subscribe to, book or otherwise enter into a specific service, additional terms may apply.
2. Our portfolio and service-specific terms
We operate businesses across consumer mobile apps, MSP community services and travel. Because these activities are different, a specific product, platform, contract, order form, app-store licence or booking may have additional terms.
If these general Terms conflict with valid service-specific terms for a transaction, the service-specific terms take priority for that transaction.
3. Acceptable use
You may use our websites and services only for lawful purposes and in accordance with these Terms. You must not:
- Attempt to gain unauthorised access to accounts, systems, data or infrastructure.
- Interfere with the security, integrity or normal operation of a service.
- Use automated tools to scrape or extract protected content or data in a way that breaches law, contractual restrictions or technical controls.
- Upload malicious code or use a service to distribute unlawful, infringing, fraudulent, abusive or harmful material.
- Misrepresent your identity, organisation, affiliation, qualifications or authority.
- Use our intellectual property, directories, content or data to create a competing dataset or service where prohibited by applicable specific terms.
We may restrict or suspend access where reasonably necessary to protect users, our systems, third parties or our legal rights.
4. Consumer apps, subscriptions and app stores
Where you download one of our apps from Apple or Google, your use may also be subject to the applicable app-store terms. Subscriptions and in-app purchases are generally billed and managed by the platform through which you purchased them. Prices, trial availability, renewal dates, cancellation methods and refund rights may therefore depend on the store and country.
Nothing in these Terms removes statutory rights that cannot legally be excluded, including applicable consumer rights.
5. MSP community platforms and B2B services
MSP Focus and Global MSP Directory may provide free and paid content, directory listings, partner services, sponsorships, research, templates and commercial services. Business customers are responsible for providing accurate information and for ensuring that materials they submit can lawfully be published or used for the agreed purpose.
Unless expressly agreed otherwise, the presence of an organisation in a directory is not an endorsement, guarantee or certification by Marketing Automation Ltd. Verification labels should be understood according to the criteria stated on the relevant service.
Consulting or partnership engagements may be governed by a separate proposal, statement of work or written agreement setting out scope, fees, deliverables, intellectual property and liability.
6. Purposeful Safaris and travel services
Travel services involve specific booking, payment, cancellation, insurance, passport, health, supplier and itinerary requirements. Those matters are governed by the Purposeful Safaris booking terms presented for the relevant enquiry or booking.
Travel arrangements may involve independent lodges, guides, transport operators and other suppliers. Their own conditions may also apply. You are responsible for ensuring that you meet passport, visa, health and insurance requirements applicable to your journey, subject to any assistance expressly agreed with us.
7. Content, trademarks and intellectual property
Unless stated otherwise, the websites, software, designs, text, graphics, brand elements, databases, templates and other materials made available by us are owned by Marketing Automation Ltd or licensed to us and are protected by intellectual property laws.
We grant you a limited, revocable, non-exclusive right to access and use public website content for your own lawful personal or internal business purposes. This does not transfer ownership. You may not reproduce, sell, license, redistribute or commercially exploit protected materials except where we expressly permit it or the law allows it.
Third-party names, logos and trademarks remain the property of their respective owners.
8. Third-party services and links
Our products and websites may link to, integrate with or rely on third-party platforms such as app stores, payment providers, analytics tools, technology services, MSP websites and travel suppliers. We do not control every third-party service and are not responsible for its content, security, availability or independent actions. Your use of a third-party service may be governed by that provider’s terms.
9. Availability and changes to services
We aim to keep our services useful and available, but we do not guarantee uninterrupted or error-free access. We may update, improve, suspend, replace or discontinue features or services where reasonably necessary. Where you have paid for a continuing service, any material change will remain subject to the terms governing that purchase and applicable law.
10. Disclaimers and liability
Public information on our websites is provided for general information and should not be treated as professional legal, financial, medical or other regulated advice unless we expressly agree to provide such advice.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or mandatory consumer rights.
For business users, and subject to any more specific contract, we will not be liable for indirect or consequential loss, loss of profit, revenue, opportunity, goodwill or anticipated savings arising from use of a free public website. Liability connected to paid products or services is governed by the relevant purchase, service or booking terms.
11. Changes to these Terms
We may revise these Terms to reflect changes to our portfolio, services, law or operating practices. The effective date at the top shows when this version applies. Material changes affecting an ongoing paid service will be handled in accordance with the specific terms governing that service and applicable law.
12. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. If you are acting as a business, the courts of England and Wales will have exclusive jurisdiction, unless a separate written agreement states otherwise.
If you are a consumer, you retain any mandatory protections and rights to bring proceedings available to you under the law of the country in which you live.
